General Conditions for the media accreditation in the FIM JuniorGP™ World Championship 2023
The processing of the Applicant personal data shall be governed by the
Regulation (EU) 2016/679, of the European Parliament and Council, dated on
April 27th 2016, for the purpose of managing the pass registration and other
purposes detailed in this document. This processing is lawful because is
necessary for the performance of the contract. The Applicant shall
always have the rights of access, to rectification, to erasure, to restriction
of processing, to object and data to portability by contacting to Dorna Worldwide, S.L.U. (DWW through letter addressed to:c/ Príncipe de Vergara, 183, 28002 Madrid, España. . Moreover, the Applicant has the right to lodge a complaint with the
Spanish Data Protection Authority. More detailed information in www.fimjuniorgp.com
The Applicant acknowledges and
accepts that due to the nature of Motorcycle racing there are inherent risks
and dangers to persons attending the FIM JuniorGP™(JuniorGP™). Furthermore, the Applicant accepts that certain Areas of the Circuit, in
particular, the Pit Lane, Team Boxes, Paddock, Track and any Areas adjacent to
the Course present additional risk to persons present in any of those Areas.
The Applicant understands and
voluntarily accepts any and all such risks and dangers. Due to the event, possibly
taking place far away from Applicant ´s home, a travel insurance
is highly recommended.
The Applicant
declares that in case of receiving a scooter sticker from DWW allowing the use
of such scooter within the paddock area, such use of the scooter shall be
subject to the paddock and pass regulations. Reception of such passes, as well
as of personal and/or parking passes, if any, imply the acceptance of the JuniorGP™ regulations, including the paddock and pass
regulations, and acknowledgment and acceptance that the scooter/s used shall
duly insured and drivers shall be in possession of the proper driving license.
Scooters above the 125cc are not permitted. The use of
helmet is mandatory when riding any scooter/motor vehicle around all areas
(paddock, Service Area, etc.).
Furthermore, the Applicant commits to
always comply with the displayed conditions at the Circuit/s, as well as with
the directions of DWW, its officials and/or nominated representatives.
The Applicant is aware that all passes
are issued by DWW and that these passes allow access only and exclusively to
the Designated Areas indicated therein. Accordingly, passes shall remain at
DWW’s sole property. DWW reserves the right to grant or refuse access to
the Circuit and/or Designated Area any person. Depending on the capacity, DWW
may restrict the access to any area of the Circuit temporally or permanently. A
pass shall only be used by the person to whom it is issued and shall not under
any circumstances be given, loaned or sold to any third party or otherwise used
whatsoever at any time by any third party different from the Applicant.
A pass shall not be altered or defaced whilst in a designed area. The Applicant
must ensure that his/her pass remains attached to its lanyard and is worn always
around the neck in such a way to be clearly visible. Under no circumstance any
advertising and/or additional instructions and/or identifications may be
affixed to any pass.
The Applicant acknowledges that image
recording inside the Circuit is subject to DWW’s approval.
The Applicant undertakes not to carry out
any activity that may damage FIM’s, FIM Europe’s, DWW’s (and/or
the companies belonging to DWW’s business group), JuniorGP’s
and its sponsors’ image and/or reputation.
The Applicant in their name and
in the name of their heirs hereby releases, waives, discharges and undertakes
not to sue DWW, the F.I.M., the F.I.M. Europe, the National
Federation of the territory in which the race is held, the teams, the circuit
management, as well as the sponsors, advertisers, other teams, riders and/or
any further related party with the organization of the championship, including
any parents or affiliated companies to any of the same, its directors,
employees or agents, all of which herein shall be referred to as “related
bodies”, from all liability before the Applicant, assignees, heirs, in connection with any and all loss or
damage, and any claim or demands for any personal injury, including death,
damage or loss of any kind that the Applicant
may suffer, sustain or cause as a result of or in connection with Applicant’s presence at the JuniorGP™. Therefore, the Applicant herewith waives in advance any right of claim that the Applicant might acquire against any of
the related bodies.
For good and valuable consideration which the Applicant acknowledges receipt, the Applicant hereby grants in exclusivity to DWW,
including any of its affiliated companies, the right to use its image and voice
arising out from his/her presence in the
JuniorGP™(in
perpetuity and worldwide) of whatever registrations and/or audiovisual recording (whatever it may be its support), for any
and all uses, including but not limited commercial and publicity uses, in any
now known or in the future developed support or media, including the right to
license or sublicense to third parties with which DWW (or its affiliated
companies) has entered into an agreement for the production of any kind of
audio-visual work around the FIM JuniorGP™
World Championship or motor sports. The Applicant expressly acknowledges that
DWW has the right to use the Pass Holder’s name, image, voice and
biographic data derived from his/her presence into the FIM JuniorGP™
World Championship for any and all uses, including but not limited for all
advertising and promotion of DWW and/or any motor sports event or exhibition
produced, presented or promoted by DWW and/or any of its affiliated companies.
DWW does not grant any image right of the attendants,
participants, workers or any other person involved or assisting to the JuniorGP™.
By applying for the accreditation and accepting, Applicant acknowledges and voluntarily and expressly accepts to be
submitted to the terms contained in this form and in the back of the
accreditation.
Any person found within a Designated Area without an appropriate Pass
shall lose any and all title to the Pass and will be immediately evicted
without prejudice to any legal proceedings which may be brought against such
person.
SERVICE ROADS CONDITIONS OF USE
If you
have an accreditation to enter the service roads, you are entitled to:
- Wear a helmet on the Service Roads when riding any vehicle. The use
of helmet is mandatory when riding any scooter/motor vehicle around all
areas (service road, paddock, etc.).
- Comply with and respect the instructions of the circuit personnel.
- Do not remain in front of the security wall along the pit-lane and
service roads.
- You must always stay behind the wall or traffic barriers.
- In case that you have a service road accreditation for your car,
you must carefully park it in order not to block accesses. You must always
foresee enough space for clear access by all official, medical and security
vehicles.
- The access to the track is completely forbidden.
The Organizer has the right to
withdraw the Accreditation at any time following any contravention by the Pass
Holder of the Conditions, without prejudice
of legal actions that the Organizer
may take for such contravention of
the Conditions by the Pass
Holder.
This document is governed by the
Laws of Spain. Any discrepancy or dispute belonging to the interpretation of
this document shall be submitted to the Courts of Madrid, Spain.
In witness whereof, the Applicant expressly
acknowledges having carefully read the present document and having fully
understood the terms and conditions thereof and signs this document freely and
voluntarily assuming all consequences that may arise from signing this
document.
